Seismic grants Aflac a personal, non-exclusive, non-transferable, limited license to use the Software as a part of the Service. This is the grant of a license, not a transfer of title, and under this license Aflac may not: modify or copy the materials; reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for any underlying intellectual property used to provide the Service, or any part thereof; violate the terms of service of the platforms and applications Aflac has authorized the Service to access; use the Services for spamming and other illegal purposes; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or "mirror" the materials on any other server.
Aflac understands and acknowledge that the Service is made available on an “AS IS” and “AS AVAILABLE” basis except as described in the Service Level Agreement (SLA). Except as outlined within the Agreement, Seismic makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Seismic does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the Service or otherwise relating to such materials or on any sites linked to this site. The materials appearing on the Service may include technical, typographical, or photographic errors. Seismic does not warrant that any of the materials on its Service are accurate, complete, or current.
Seismic or licensor may make changes to the materials contained on its Service or the functionality and design of the Service at any time without notice. Seismic does not, however, make any commitment to update the materials or enhance the service. Grapevine6 reserves the right to discontinue offering the Service at any time; provided, however, that in the event Grapevine6 elects to discontinue the Service prior to the end of the Initial Term or any Renewal Term, then Grapevine6 will refund to the Customer a pro-rata refund of the subscription fees paid for the undelivered portion of the Initial Term or Renewal Term (as the case may be).
Aflac agrees that Aflac will not reproduce, copy, duplicate, sell, resell, rent or trade the Service (or any part thereof) for any purpose. Aflac agrees that will access the Service with Aflac’s own account only. Aflac is responsible for maintaining the security of user names and passwords at the user level and for promptly changing or deleting any user name or password that Aflac believe may have been compromised. Grapevine6 reserves the right to institute password requirements (such as the length of password or the required use of numbers, symbols etc.) and to refuse registration of, or cancel passwords it deems inappropriate.
Seismic has not reviewed all of the websites and third-party content accessible through and linked to by the Service and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Seismic of the site or source material. We are not responsible for and assume no liability for any mistakes, misstatements of law, defamation, omissions, falsehood, obscenity, pornography or profanity in the statements, opinions, representations or any other form of content on the Site. Aflac understands that the information and opinions in the third party content represent solely the thoughts of the author and is neither endorsed by nor does it necessarily reflect our belief. Use of any such linked website is at the user's own risk. Seismic is not responsible or liable for actions taken by a third-party as a direct or indirect result of actions taken by the User.
Upon termination of Aflac’s account Aflac lose all access to the Service and any associated account data, and Grapevine6 may, but is not obligated to, delete any archived data associated with Aflac’s account. Seismic will not be responsible to Aflac or any third party for any damages that may result or arise out of such termination or suspension of Aflac’s account and/or access to the Service.
The Service may include certain communications, such as service announcements, administrative messages and newsletters. Aflac understands that these communications shall be considered part of using the Services. Aflac has the option of opting out from certain communication related to the functions of the system (notifications). However, Aflac will not be able to opt-out from receiving service announcements and administrative messages.
Grapevine6, the stylized G logo and other trademarks, service marks, graphics, and logos used in connection with the Service are trademarks or registered trademarks of Grapevine6. Other trademarks, service marks, graphics, and logos used in connection with the Service may be the trademarks of their respective owners. Aflac is granted no right or license in any of the aforesaid trademarks, and further agree that Aflac shall not remove, obscure, or alter any proprietary notices (including trademark and copyright notices) that may be affixed to or contained within the Service.
